UK ILR for Spouse & Partners

Eligibility Requirements for ILR AS a Spouse ( 5-Year Route )

• The applicant must submit a valid application for Indefinite leave to remain/settlement as a spouse;
• The applicant can apply for Indefinite leave to remain 28 days before completing 5 years in the UK, which means that the applicant must have completed the qualifying period of 4 years 11 months and 2 days at the time of submitting an online application for ILR as a spouse;
• The applicant must be currently in the UK under a Spouse visa and should apply prior to the expiry of their visa;
• The applicant must be the spouse of a British citizen, a person settled in the UK, someone in the UK with refugee leave or with humanitarian protection. The relationship of the applicant with the UK Sponsor must be genuine and subsisting;
• The applicant must meet the suitability requirements as set out in Appendix FM of the Immigration Rules
• The applicant should meet the financial requirement for Indefinite leave to remain as a spouse. The requirement can be met through income of the applicant and/or UK sponsor and/or savings of the applicant and/or UK sponsor, or through rental income;
• The applicant must provide evidence that there will be adequate accommodation, without recourse to public funds, for the family (including other family members who are not included in the application but who live in the same household), which the family owns or occupies exclusively;
• The applicant must meet the English Language requirement by having a recognised English qualification with at least level B1 in speaking and listening or a degree taught or researched in English;
• The applicant must meet the Life in the UK test requirement.
